When does an applicant have Arranged Employment?

In general, Arranged Employment means that the applicant has a genuine offer of employment from a Canadian employer for a full-time, paid job in a skilled occupation. The job offer must have an indeterminate length of employment and be conditional upon the applicant becoming a permanent resident.

Prior to May 4, 2013, most applicants were required to have the Canadian employer validate the job offer with Service Canada through an “Arranged Employment Opinion”. However, the new regulations for the FSWP now require the Canadian employers to validate the job offer by obtaining a Labour Market Opinion (LMO) from Service Canada. However, an LMO is not required in certain circumstances.

Who does not require an LMO?

The following two categories of applicants do not require an LMO to benefit from Arranged Employment:

  • Applicants who are currently working in Canada on a temporary work permit in a skilled occupation, where the work permit was originally issued based on a positive LMO.
  • Applicants who are currently working in Canada on a temporary work permit in a skilled occupation, where the work permit was originally issued without an LMO under the provisions of an international agreement (e.g. the North America Free Trade Agreement ) or under the provisions of one of the Canada-Provincial/Territorial Immigration agreements (e.g. the Canada-Ontario Immigration Agreement).

In both these circumstance, the following conditions must be met for the applicant to benefit from Arranged Employment:

  • The Canadian employer specified on the applicant’s work permit must extend a non-seasonal full-time job offer to the applicant for the same position specified on the work permit, and the job offer must be for an indeterminate length of employment conditional upon the applicant becoming a permanent resident;
  • The applicant’s work permit must be valid at the time the Federal Skilled Worker application is submitted; and
  • The applicant must have the valid work permit for the same employer in the same position until the Permanent Resident Visa is issued.

Who does require an LMO?

As a general rule, any applicant who has a suitable job offer from a Canadian employer, but who does not have a valid temporary work permit and is not authorized to work in Canada must have the Canadian employer obtain an LMO prior to submitting their FSWP application in order to benefit from Arranged Employment.

In some cases, foreign workers who are currently working in Canada are still required to have their employers obtain an LMO to benefit from Arranged Employment. This includes the following types of applicants:

  • Foreign workers who have a job offer from a Canadian employer that is different from the employer indicated on their work permits;
  • Foreign workers who have work permits that were issued without an LMO due to exemptions other than those noted above, e.g. the Intra-Company Transfer category;
  • Foreign workers who have open work permits (not linked to any specific employer); and
  • Individuals who are authorized to work in Canada without a work permit, such as business visitors.

One interesting aspect of the new Arranged Employment regulations is that an LMO obtained from Service Canada entitles the applicant to a temporary work permit immediately. Thus, the applicant may be able to come to Canada as a tempoary foreign worker immediately, while their permanent residence FSWP application is still being processed.

“Holding a Canadian job offer opens up opportunities for immigrants before and after they land in Canada,” said Attorney David Cohen. “Not only will it benefit their application for Permanent Residency, it can allow an applicant to come to Canada within a couple of months and begin working right away.”

Требования к заявителям по программе Federal Skilled Workers

Экспресс Энтри: общая информация

Express Entry – это достаточно молодая онлайн-система отбора кандидатов для иммиграции в Канаду. Она оценивает личностные и профессиональные качества человека и на основе этого присуждает определенный балл. Чем он выше, тем выше ваши шансы на переезд.

Не стоит путать Express Entry с программой иммиграции! Как было сказано – это только система для отбора кандидатов на балльной основе. Многие федеральные и провинциальные программы используют её для поиска подходящих кадров.

Также важно отметить, что в этой системе вы не можете участвовать в конкретной программе. Она сама выбирает на основе введенной вами информации, под какие программы иммиграции вы попадаете. Если попадаете под 2 программы, значит будете ранжироваться по двум и можете получить приглашение по любой из них.

Однако, когда приходит приглашение на подачу документов (если вы подошли), указывается программа, по которой вам предлагают иммигрировать. И тут вы можете сделать выбор – согласиться на переезд по этой программе, либо отклонить и ждать приглашения по другой.

Для кого актуальна эта система

У каждой программы иммиграции свои требования к стажу и квалификации. Но год работы по профессии – это минимум.

Под эту систему попадают 3 федеральные программы:

Federal Skilled Worker. Самая популярная программа в Express Entry 2020, так как не требует опыта работы в Канаде или приглашения на работу в этом государстве.

Federal Skilled Trades. Эта программа подойдет тем, кто имеет опыт работы по определенным профессиям, которые актуальны для Канады.

Canadian Experience Class. Программа для тех, у кого уже есть опыт работы в Канаде. Статья о том, как найти работодателя в этом государстве.

И множество провинциальных.

Процесс иммиграции через EE

На самом деле все достаточно просто:

Регистрация в системе, создание и заполнение профиля.

Сначала нужно зарегистрироваться. Подробнее об этом в соответствующем пункте ниже.

После потребуется создать профиль и ввести всю необходимую информацию о личностных особенностях, а также образовании, работе, финансах.

Оценка вашего профиля.

Если вы соответствуете минимальным требованиям (про это в пункте ниже), то вы попадаете в пул кандидатов – это список всех участников Express Entry, которые претендуют на попадание в одну из программ для переезда в государство.

Примерно раз в 2 недели происходит отбор: автоматически оцениваются баллы всех кандидатов и тем, у которых он выше, приходит приглашение на подачу документов. Ознакомиться со статистикой вы можете в статье – проходной балл в Express Etnry.

Важно! Если осталось только 1 место, и ваш балл подходит, но при этом такой же балл ещё у 10 человек, то пройдет тот, кто раньше отправил свой профиль. А остальные вернутся обратно в воронку и будут ждать нового раунда приглашений.

Также стоит знать, что, если вы обновите свой профиль, то дата первой подачи сохранится. Однако, если вы удалите старый профиль и создадите новый, либо срок его действия подошел к концу, то ваш профиль будет иметь новое значение даты.

После получения приглашения необходимо предоставить документы, которые подтверждают введенную информацию, а также дополнительные. Об этом будет также подробнее рассказано ниже в пункте с документами.

До тех пор, пока вам не придет приглашение на подачу документов, вы можете изменять информацию в профиле, тем самым повышая свой общий балл и шансы. Но имейте в виду, что в дальнейшем всё это будет необходимо подтвердить документами.

Минимальные требования для кандидатов

Чтобы попасть в пул кандидатов в системе Express Entry, необходимо соответствовать минимальным требованиям:

  • быть совершеннолетним;
  • иметь минимум 1 год рабочего стажа;
  • в большинстве случаев (но не всех) нужно иметь определенные финансовые сбережения. Подробнее об этом в статье: сколько денег нужно для иммиграции в Канаду;
  • знания одного из государственных языков (английский или французский) на уровне не ниже 4 CLB для некоторых провинциальных программ и 5 CLB для федеральных. Подробнее о том, что такое CLB.

Попадание в число участников Экспресс Энтри ещё не гарантирует, что вы будете отобраны и приглашены. Это лишь первый шаг.

Советы, как заранее подготовиться, чтобы попасть в пул EE

Все мы должны осознавать, что этот процесс очень сложный и длительный. Чтобы все завершилось успехом, в большинстве случаев необходимо готовиться заранее. Конечно, для тех, кто сейчас работает или учится в Канаде (или работал / учился раньше), все гораздо проще, но таких здесь меньшинство.

Мы рекомендуем заранее:

  • улучшить знание языка. Английского или французского. Владение одним из них на высоком уровне – это хороший задаток для успешной иммиграции;
  • получить опыт работы, если его нет или недостаточно. Иммиграция – это не быстрый процесс, поэтому возможно и такое, что вы потратите 1-2 года на получение необходимого опыта работы, перед тем, как подать заявку;
  • улучшить свое образование. Например, вы закончили бакалавриат. В большинстве случаев после этого можно пойти учиться (хотя бы на платной основе) на магистра (1-2 года в зависимости от вашей ситуации), что даст дополнительные баллы;
  • оценить образование. Обратитесь в специальное аккредитованное агентство, чтобы оценить дипломы на основе канадских стандартов. Это поможет правильно выбрать ваш уровень образования в Express Entry.

Необходимые документы

Все документы, которые вам потребуются, можно разделить на 2 части:

Документы для профиля.

Это те документы, на основе которых вы должны заполнить свой профиль. Как было сказано, информация в профиле должна быть достоверна, а подтверждается это документами.

Вам не нужно будет их загружать, чтобы отправить свой профиль на рассмотрение. Но потребуется, когда вам придет приглашение на переезд.

Это те документы, которые вам нужно будет получить после того (хотя можно и заранее), как получите ITA (приглашение на подачу документов на ПМЖ). А после прикрепить и отправить на рассмотрение.

Что делать, когда вы получили приглашение на проживание в Канаде

Если вы отправили полный пакет документов и требуемую информацию, то на рассмотрение уйдет до 6 месяцев. Может и меньше.

Далее все просто. Каждое изменение и новая информация будут отображаться в профиле.

Если вы только создали профиль, но не заполнили его до конца и не отправили на рассмотрение, то он будет держаться в системе 60 дней.

Если вы полностью отправили профиль, то он будет активен в течение 1 года, либо до тех пор, пока вам не придет приглашение, и вы примете его.

Что будет, если отклонить заявку на подачу документов для проживания?

В таком случае ваш профиль отправляется обратно в пул участников и будет активен до конца года (с момента первого отправления этого профиля).

Могу ли я заранее выбрать программу, в которой хочу участвовать?

Нет. Система Express Entry сама определяет, под какие программы вы подходите. Если ваши данные актуальны для нескольких программ, значит вы будете ранжироваться по нескольким.

При этом, когда приходит приглашение на иммиграцию, указывается название программы. Если она вам не подходит (а такое бывает, но очень редко), то вы можете отклонить приглашение. Ваш профиль останется не тронутым и продолжит участвовать в отборе.

A valid job offer, also known as an offer of employment or an arranged employment offer, could significantly enhance your chances to immigrate to Canada under the Express Entry system. You need to know, the specifications of the job offer depend on the subcategory of Express Entry you are applying. Just as a quick reminder, the subcategories of Express Entry are the following:

Job offer for FSWP and CEC

A job offer for FSWP or CEC needs to meet the following criteria:

  • Be valid for at least one year from the time you become a permanent resident of Canada
  • Be full-time or rather at least 30 hours per week
  • Be paid and continuous
  • Be issued by one employer only
  • Fall under NOC 0, A, or B

IRCC does not accept seasonal, self-employed, or contract-basis jobs.

Job offer for FSTP

A job offer for FSTP needs to meet the following criteria:

  • Be valid for at least one year from the time you become a permanent resident of Canada
  • Be full-time or rather at least 30 hours per week
  • Be paid and continuous
  • Be issued by less than three employers
  • Fall under acceptable jobs for FSTP

IRCC does not accept seasonal, self-employed, or contract-basis jobs. Part-time jobs are acceptable only if you receive valid offers from two employers and the combination of two offers is equivalent to a full-time job. For example, you will work 10 hours per week for the first employer and 20 hours per week for the second one.

LMIA and Job Offers

Generally speaking, a job offer needs to be backed by a positive permanent residency LMIA (Labour Market Impact Assessment). However, your employer may not need a permanent residency LMIA if either of the following scenarios applies to you.

  • You are currently working for the employer with a valid work permit backed by an LMIA. Your work permit is valid at the time of applying under Express Entry and remains valid till they finalize the application. For CEC and FSWP applicants, the NOC must be 0, A, or B. For FSTP applicants, the job must be the same job that you mention on your permanent residency application.
  • You are currently working for the employer with a valid work permit that is exempt from an LMIA. You have at least one year of full-time work experience in Canada with the same employer and the same LMIA-exempt job.

A simple work permit is not good enough. For example, you may not apply because you hold a valid post-graduate work permit (PGWP) or an open work permit because of your spouse. Your work permit needs to be an employer-based work permit. You also need to meet the rest of the requirements I present in this article.

The Content of the Job Offer Letter

When you submit your application you need to show a job offer letter from your employer. The job offer letter must include the following:

  • Start date of the job and validity of it. For example, it clearly says the job offer is valid for at least one year from the day you become a permanent resident of Canada. It may also be an indefinite job offer (or rather no expiry date)
  • The name and contact information of the employer (address, website, email, phone numbers, etc.)
  • LMIA number, if applicable. If the job is exempt from an LMIA present the existing work permit with at least one supporting document.
  • NOC code of the job
  • The job title and duties
  • The salary, hours of work, benefits, deductions, etc.

IRCC does not accept job offers from a high commission, an embassy, or a consulate in Canada.

Just because you are working for an employer in Canada, does not mean you have a job offer. You need to receive the job offer in writing with the specifications I have indicated in this article. I also highly recommend reading the following articles.

Express Entry

Canada is changing its economic immigration programs to give more opportunities to prospective skilled immigrants. Starting January 2015, skilled foreign workers will have access to Express Entry, which will cover Canada’s key economic immigration programs:

  • the Federal Skilled Worker Program,
  • the Federal Skilled Trades Program,
  • the Canadian Experience Class, and
  • A portion of Provincial Nominee Programs

Candidates who are invited to apply for permanent residence under the Express Entry system will benefit from fast processing times of six months or less.Express Entry will also provide a pathway for skilled workers to connect with potential job opportunities in Canada prior to arrival.Express Entry will ensure that the candidates who are most likely to succeed economically – not simply those first in line – are able to immigrate to Canada.

How Express Entry Works

Step 1

Potential candidates create an online Express Entry profile

Express your interest in coming to Canada as a skilled foreign worker. Starting in January 2015, create an online Express Entry profile and tell us about your skills, work experience, language ability, education and other details.

Before doing this, you will need to take a language test in English or French. If you were educated outside of Canada, you may also need to have your education assessed against Canadian standards. More information on language and education assessments is available online.

If you meet the criteria of one of the federal economic immigration programs subject to Express Entry, you will be placed in a pool of pre-screened candidates.

If you do not already have a Canadian job offer or a nomination from a province/territory, you must register with the Government of Canada’s Job Bank. Job Bank is an easy, online search tool that will help you get matched with jobs in Canada based on your skills, knowledge and experience.

Express Entry Pool

You will be given a score to determine your place in the Express Entry pool using a Comprehensive Ranking System that includes factors known to contribute to economic success (such as language, education, and work experience).

There will be regular draws of candidates from the Express Entry pool, inviting them to apply for permanent residence. Candidates with the highest scores, including those who have a valid job offer or a provincial/territorial nomination, will be invited to apply.

Your Express Entry profile will be valid for 12 months. During that time, you will need to update your profile if circumstances change, such as your level of education or language test results.

Important: Filling out an online Express Entry profile is not a guarantee that you will qualify for permanent residence. If you are invited to apply for permanent residence, information provided in your Express Entry profile will be verified at that time.

Step 2

Selected candidates are invited to submit an electronic application for permanent residence

You will receive an Invitation to Apply for permanent residence if you:

  • have a valid job offer from an employer in Canada (subject to the Labour Market Impact Assessment process in place at that time);
  • have been nominated by a province or territory; or
  • are among the top ranked in the pool based on your skills and experience.

Citizenship and Immigration Canada will process the majority of complete permanent residence applications received within six months or less.

Candidates in the Express Entry pool who do not receive an Invitation to Apply for permanent residence after 12 months can resubmit their profile and re-enter the pool if they still meet the criteria.
