It is a two-week processing time standard for certain work permits for foreign workers in high-growth companies and sectors.

With this way, employment and Social Development Canada (ESDC) successfully recruit highly-skilled workers in key occupations, and expedite their arrival in Canada.

Two new work permit exemptions are also in effect as of June 12. Canada Global Talent Stream 2020

By means of the Global Talent Stream, an efficient skilled worker can receive a work permit within a period of two weeks after applying. It facilitates the growth of the creative companies due to being an important part of Canada’s Global Skills Strategy. It allows such companies to reach talented workers easily and fast. Canada Immigration Global Talent Stream is known for taking only two weeks to process a work permit application (and temporary resident visa for the worker with high skills).

Remember: The Global Talent Stream is a category of Canada’s Temporary Foreign Worker Program.

Global Talent Stream: Category B

Employers wish to hire international skilled workers for specific occupations under the National Occupation Classification (NOC) come into Category B. Employers falling under any category must fulfill below mentioned criteria for skilled workers wages. International workers recruited through Global Talent Stream must be given a salary amount equivalent to current wage or above.

The current wage must be higher than:

  1. Canada Job Bank occupation’s average wage
  2. the salary amount paid by an employer to his existing staff under same position at the same location, holding the same skills and work experience
  3. the minimum salary amount stated in the Global Talent occupations list for few occupations

Labour Market Benefits Plan under Global Talent Stream

Employers wishing to recruit international skilled workers via Global Talent Stream must fulfill the requirements of Employment and Social Development Canada (ESDC) in order to achieve the Labour Market Benefits Plan.

According to the plan, the international skilled workers to be hired must bring positive benefits to the labour market of Canada, and their Canadian employers must create jobs and invest skills and training.

Category A employers


They must create jobs for Canadian citizens and permanent residents through direct or indirect ways.

Category B employers

They must invest skills and training programs for Canadian citizens and permanent residents.

Canada Work Permit: Global Talent Stream

Under the Global Talent Stream, skilled workers can expect their Canada work permits and Canada visa applications processed within two weeks. The program was launched on June 12, 2020, with Quebec unveiling its version of the program on September 11, 2020. GTS forms part of the Temporary Foreign Worker Program.

The federal government wants to help high-growth companies bring in the talent they need quickly by cutting processing times for a Canada visa application from six months to just 10 business days.

A key element of the Global Talent Stream is that registered employers will need to commit to creating jobs for Canadians and transferring knowledge to Canadian workers, under a Labour Market Benefits Plan.

What is the Labour Market Benefits Plan?

A key requirement for GTS is the Labour Market Benefits Plan (LMBP).

Developed with ESDC, it must show how hiring a foreign worker will help a company either create jobs for or transfer skills to Canadians. It also allows the ESDC to track a company’s progress.

The LMBP features mandatory and complementary benefits.

Under Category A, the mandatory benefit is creating jobs, whether directly or indirectly, for Canadian citizens and permanent residents.

Under Category B, the mandatory benefit is to increasing skills and training investments for Canadians and permanent residents.

The LMBP must also provide two complementary benefits, which cannot be the same as the mandatory benefit. These include, but are not limited to:

  • Job creation,
  • Investment in skills and training,
  • Transferring knowledge,
  • Enhanced company performance and
  • Implementing best practices or policies as an employer for your workforce.

Global Talent Stream: General Requirements

Business Legitimacy

Employers must provide evidence they are actively engaged in the business needing the temporary worker. The business must provide a good or service related to the job offer.

Employers new to TFWP must submit one document as proof. Returning employers are not required to re-submit documents, but may be asked for additional proof.

Allowable documents include a Canadian business licence, legal incorporation forms, tax documents and attested documents. For a full list, click here.


Recruitment

Employers are encouraged to actively seek to hire Canadians and permanent residents before looking abroad for workers. A description of how this has been done will be requested.

Wages

Wages must match the prevailing amount paid to Canadians and permanent residents for the same position.

Job Duties and Working Conditions

Workers hired under TFWP must only do the job they were hired for. Foreign workers are covered by the same laws that protect Canadians and permanent residents. Exploitation of a foreign worker violates Canadian law.

Provincial and territorial laws cover standards such as:

  • Hours of work (including overtime)
  • Compensation
  • Working conditions
  • Termination of employment

Workplace Safety

Foreign workers must be covered by provincial or territorial workplace safety insurance where required by law. Any private plan must match or better the terms of the provincial or territorial plan.

Language Restriction

A job can only require English or French when advertised. If other languages are essential, justification is required at the application stage.

Unionized Positions

For positions covered by a union, the foreign worker must be treated the same as Canadians and permanent residents also covered by that union, in terms of wages and terms and conditions.

Employer Compliance

Employers must comply with all general requirements of the TFWP.

Employers in Quebec

As of September 11, 2020, Quebec employers are able to take full advantage of the Global Talent Stream. The key difference is that Quebec employers must submit their application simultaneously to ESDC and the Quebec Ministry of Immigration, Diversity and Inclusion.

As part of Canada’s Global Skills Strategy, the Global Talent Stream enables prioritized processing of applications for work permits in high-demand occupations requiring the specialized talent of global workers. The government of Canada recognizes that in order to promote growth in fast-paced industries such as the tech sector, employers often need to fill a specialized position quickly, and are unable to find Canadian workers for the position.

In such cases, the GTS establishes a processing time standard of 10 business days for Labour Market Impact Assessment (LMIA) and work permit applications from workers whose employers have been approved to hire through the GTS. Employment and Social Development Canada (ESDC), the department managing this stream, has stated that this pilot program will run for an initial period of 24 months.

The LMIA is a document that proves that the employer could not find a Canadian citizen or permanent resident who is ready, able, and willing to perform the job. Once an employer has obtained an LMIA, the worker may apply for a work permit.

Two Categories

There are two categories under the GTS.

  • Category A: High-growth companies with a demonstrated need for the in-demand talent of foreign nationals in order to generate growth; and,
  • Category B: Companies requiring high-skilled foreign nationals for occupations on the Skills Shortage List.

It is acknowledged that companies in both of these categories will generate job growth among Canadian workers, in addition to growth in the national economy, as a result of the efforts of foreign nationals. Moreover, the specialized knowledge of these foreign workers will result in greater skills and training of Canadian workers.

Companies in any sector may be eligible for Category A, but must first be recommended to the GTS by a designated partner, and need to be identified as high-growth. The following organizations have been designated as GTS referral partners, as of June 12:

Further requirements for Category A are in place, including the need to prove that the company is hiring unique and specialized talent. Future employees with advanced knowledge of the industry, advanced relevant qualifications, and/or a minimum of five years’ specialized experience may be eligible. In addition, the position must be highly paid, usually at $80,000 CAD per year or higher.

Companies who can demonstrate a need for global talent to fill high-skilled occupations on the Global Talent occupations list, and are willing to pay the employee the prevailing wage or higher, fall into Category B.

The following high-demand occupations have been identified as areas in which there is a skills shortage in Canada. This list was developed in consultation with labour market experts and key stakeholders, and ESDC states that it may be updated periodically.

Positions in occupations 2241, 2283, and 5241 carry minimum wage requirements.

Work permit exemptions

Two new work permit exemptions are also in effect as of June 12. Workers in occupations classified as skill type 0 or skill level A in the NOC may enter Canada for one 15-day stay in a six-month period, or one 30-day stay in a 12-month period, and may work without a work permit. Researchers undertaking projects in Canada may stay for 120 days in a 12-month period, without requiring a work permit, as long as they are working on a research project at a publicly-funded degree-granting institution or affiliated research institution.

Канада обновила список профессий для Global Talent Stream

5 июля 2020 года Министерство человеческих ресурсов и социального развития Канады (Employment and Social Development Canada, ESDC) обновило список профессий, на которые распространяется действие программы Глобального потока талантов (Global Talent Stream, GTS).

Как заявили чиновники, список был обновлен, с целью лучшего отражения нужд канадского рынка труда и потребностей инновационных компаний. Техники компьютерных сетей (NOC 2281 Computer network technicians) были добавлены в список, а инженерные менеджеры (NOC 0211 Engineering managers), менеджеры по архитектуре и науке (NOC 0212 Architecture and science managers) напротив были удалены из списка.

Заявки, поданные по профессиям, которые были удалены из списка, будут приниматься ESDC до 4 августа 2020 года. Любая заявка, полученная после этой даты в категории B Global Talent Stream, не будет обрабатываться.

Ранее мы сообщали, что эта программа стала постоянной в марте 2020 года. Канада приняла 24000 иностранцев через GTS за последние два года. Время обработки заявок в этой программе составляет всего две недели.

Владельцы канадских компаний смогут вызывать квалифицированных работников из любой точки земного шара в соответствии с нуждами компании. Самое главное, что обладатели разрешений на работу в рамках GTS получат предпочтение при получении постоянного места жительства.

Эта программа имеет две категории, A и B. Категория A требует годовой оклад не менее 80 000 долларов для первых двух заявок, тогда как для последующих приложений она составляет 150 000 долларов. Для высококвалифицированной должности в категории B, допустимая минимальная заработная плата для профессии, указана в списке профессий для этой программы.

Поток Global Talent Stream является частью канадской стратегии по привлечению профессионалов из-за рубежа, целью которой является обеспечение экономического роста страны. Все документы участников этой программы будут оформлять не больше двух недель, это включает все необходимые бумаги для супругов иммигрантов и разрешение на учебу для их детей.

Работодатели из Квебека также получают внушительное преимущество: они могут нанимать специалистов из-за границы по упрощённой процедуре, чтобы заполнить вакансии по профессиям, на которые существует высокий спрос.
