This publication answers general questions related to the wage recovery system that is outlined in Part III of the Canada Labour Code (the Code). It applies to employees and employers in works, undertakings or businesses under federal jurisdiction as described in the Summary pamphlet in this series.

1. The wage recovery system

The wage recovery system is a legislated tool for the collection of an employee’s unpaid wages or other amounts owing. The system also provides an administrative review process and an appeal mechanism to parties who disagree with an inspector’s findings.

2. Handling cases of non-payment of wages

The Labour Program assigns an inspector to investigate any complaints filed by an employee within six months from the last day the employer was required to pay the wages.

3. Actions taken by an inspector

An inspector investigates to determine whether a complaint is founded. If the monetary complaint is founded, the inspector attempts to have the employer voluntarily pay the wages or other amounts owing before issuing a Payment order. If the employer voluntarily complies, the inspector may issue a Notice of voluntary compliance. If the complaint is unfounded, the complainant (employee) will be notified of the inspector’s finding in writing. A Notice of unfounded complaint may subsequently be issued to the complainant.

4. Administrative fees

When a Payment order is issued to an employer, an administrative fee of $200 or 15% (whichever is greater) will be added to the wages or other amounts owed.

5. Director’s liability

When wage recovery from a corporation is impossible or unlikely, directors may be held liable for amounts due to an employee or employees during their incumbency. Corporate directors are jointly and individually liable for employees’ wages and other amounts owed, such as severance and notice pay, up to a limit equivalent to six months’ wages.

6. Review and appeal of an inspector’s Notice of unfounded complaint and Notice of voluntary compliance

A Notice of unfounded complaint or Notice of voluntary compliance may be reviewed. To do this, an employee must make their request to the Minister of Labour, with written reasons and within 15 days after the notice was served. Upon completion of the review, the Notice of unfounded complaint or Notice of voluntary compliance could be confirmed, amended or overturned.

The review decision could be further appealed to a referee, but only on a question of law or jurisdiction. Some cases may be referred directly to a referee to be heard.

7. Review and appeal of a Payment order

A Payment order may be reviewed. To do this, an employee, an employer or a director of a corporation must make their request to the Minister of Labour, with written reasons and within 15 days after the Payment order was served. An employer or director must also provide a payment for the amount indicated in the Payment order, or a Letter of credit in lieu of payment, plus applicable administrative fees. Upon completion of the review, the Payment order could be confirmed, varied or overturned.

8. Payment order as a court judgement

A Payment order issued by an inspector or a reviewer that remains unpaid may be registered in the Federal Court of Canada system if a party to the Payment order makes such a request to the Minister. Following court proceedings, the Payment order could be upheld as a court judgment.

Once a Payment order has been filed in the Federal Court, the statutory authority of the Labour Program ends. This means that the Labour Program no longer has the authority to enforce the Payment order.

9. Claims against a debtor

A claim against a debtor of an employer or director, up to the amount stated in the Payment order, maybe issued by a Labour Program inspector. The debtor would be required to pay the amount to the Minister within 15 days.

What is a Credit Report?

A credit report is a document put together by credit bureaus and it details how you have used credit over the years. Your credit report shows your:

  • Personal information including your name and address (current and previous)
  • Employment: current and previous
  • Open and closed credit/loan accounts, account payment history, all outstanding balances
  • Credit inquiries
  • Collections, bankruptcies, lawsuits, foreclosures, if any

Essentially, it shows your financial history, how you have used credit in the past, and how you are currently managing your debts. Lenders report all this information to the credit bureaus and they update your credit report on a regular basis.

When you want to open a new credit facility e.g. personal loan, credit card or mortgage, the lender pulls your credit report and score to assess your creditworthiness i.e. how risky is it to do business with you and what are the chances you will default and be unable to pay them back.

What is a Good Credit Score in Canada?

A credit score is the summary of your credit report using a 3-digit number. You can say a credit score is a snapshot of your creditworthiness and is calculated using various formulas.

Credit scores range from Poor (300-559) to Very Good (725-759) and Excellent (760-900). When you have a Very Good to Excellent credit score, you qualify for better interest rates and offers.

Why Your Credit Report and Credit Score Are Important

There are many good reasons for why you should ensure your credit report and score are in good standing:

  • If you become a victim of identity theft or fraud, your credit report is one place to detect it. Identity/credit fraud can get you into lots of trouble, including loss of money and a tainted reputation.
  • Your credit report/score will affect your ability to secure a loan, mortgage, credit card, etc.
  • Your credit report/score can significantly affect your day-to-day living, including your eligibility for a job, rental, cell phone contract, etc.
  • Financial institutions and credit bureaus are prone to making mistakes and your credit rating can become damaged through no fault of your own.

To avoid any of these problems, it’s important you look through your credit report one to two times a year as well as monitor your credit score for any red flags or fraudulent activity.

How To Get Your Free Credit Report in Canada

In Canada, you are entitled to one free credit report per year from each of the credit bureaus. The major credit bureaus in Canada are TransUnion and Equifax. This free credit report may also be referred to as “Consumer Disclosure” or “Credit File Disclosure,” and does not show your credit score.


TransUnion now offers four ways to request your credit report:

  • Online: This is a quick and easy way to view your credit report online. I was able to view mine in less than 5 minutes!
  • Mail: Download their Consumer Request form, complete it and mail to – TransUnion Consumer Relations Centre, PO Box 338 LCD1, Hamilton, Ontario L8L 7W2.
  • In Person: Visit one of their offices to request your free report. For both mail and in-person requests, you will need 2 pieces of ID.
  • Phone: Request your credit report by calling 1 (800) 663-9980.


There are 3 ways to request your credit report from Equifax:

  • Mail/Fax: Download and complete their Request Form and mail to – National Consumer Relations, Box 190 Jean Talon Station, Montreal, Quebec H1S 2Z2, or fax the completed form to (514) 355-8502.
  • Phone: Call their automated interactive system at 1-800-465-7166. You will need your SIN.
  • In Person: Visit one of their offices and request a free copy of your credit report. You will need 2 forms of valid ID for both in-person and mail requests.

How To Get Your Free Credit Score in Canada

The credit report provided by TransUnion and Equifax does not contain your credit score. They want you to pay $$ for that. Here are four companies that will provide your credit score for free:

1. Borrowell: Sign up to see your credit score (Equifax) and get monthly updates. They will also show you your credit report.

2. Credit Karma: Get weekly updates on your credit score (TransUnion). They will also show your credit report.

3. Mogo: Get monthly updates on your credit score (Equifax). Not available in Quebec.

4. Ratehub: You can obtain a one-time free Equifax credit score.

Will Checking Your Credit Score Affect It?

There are 2 main types of checks (inquiries) that can occur when lenders pull your credit: “soft check” and “hard check.”

A hard check is made by lenders who want to get a full idea of your creditworthiness in order to approve or disapprove your application for credit. Hard checks impact your credit score negatively.

Soft checks occur when a lender pulls your credit just to get a background on you. For instance, during a mortgage pre-approval, or if your bank wants to pre-approve you for a credit card offer. Checking your own credit score is also considered a soft check, and it does not impact your score.

Consumer protection – Administrative penalties

Administrative penalties are a monetary sanction assessed by the Director of Fair Trading.


An administrative penalty can be issued if the Director of Fair Trading finds that a person:

  • has breached a provision of this act or the regulations
  • has failed to comply with a term or condition of a licence issued under this act or the regulations

The Director may, by notice in writing given to the person, require the person to pay to the Crown an administrative penalty in the amount set out in the notice.

How much a penalty is

In setting the amount of the administrative penalty, the Director may consider a number of factors, including:

  • the seriousness of the contravention or failure to comply
  • the degree of wilfulness or negligence
  • the impact on any person affected by the contravention or failure to comply
  • if there is a history of non-compliance by the person
  • whether or not there were any mitigating factors relating to the contravention or failure to comply
  • whether or not the offender has derived any economic benefit from the contravention or failure to comply
