23 Февраля 2020 Онтарио, вновь открыла провинциальную программу, в частности категорию Ontario Human Capital Priorities immigration stream для квалифицированных специалистов. Иммиграционная категория Human Capital Priorities immigration stream, это один из т.н. иммиграционных потоков провинциальной программы Онтарио (OINP — Ontario Immigrant Nominee Program) которая предназначена для тех, кто подал свою кандидатуру на иммиграцию в Канаду через систему Express Entry.

В последний раз данная категория иммиграционной программы Онтарио, открывалась в начале прошлого года и была доступна для подачи заявлений до 9 мая 2020 года. В 2020 году правительство Онтарио, вновь решила открыть иммиграционный поток Ontario Human Capital Priorities immigration stream для всех кто соответствует критериям и требованиям Express Entry.

Отобранные кандидаты из системы Express Entry смогут получить провинциальную номинацию OINP от Онтарио и в результате получить дополнительно 600 баллов по рейтинговой системе CRS (Comprehensive Ranking System). Замечание. Кандидаты, получившие одобрительное письмо от OINP , получают уведомление Notification of Interest (NOI), которое служит приглашением на подачу документов в иммиграционный комитет Онтарио. Одобренные кандидаты будут иметь только 45 дней с момента получения NOI, чтобы подготовить все необходимые документы и подать в иммиграционные службы Онтарио. International Student — Masters Graduate и PhD Graduate streams.

В повторном открытии иммиграционной программы Ontario Human Capital Priorities immigration stream, были также открыты две категории International Student — Masters Graduate и International Student — PhD Graduate streams. Данные категории предназначены для талантливых и высоко образованных людей, которые успешно окончили высшее образование в Канаде. Правительство Онтарио, как Министерство Иммиграции Канады признает, что иностранные студенты, выпускники высших учебных институтов должны быть в первом приоритете на получение статуса постоянного резидента Канады.

Иностранные студенты получившие академическую степень Master Degree или PhD, имеют право подавать свою кандидатуру на статус постоянного резидента Канады(Permanent Residence), без предварительного опыта работы в Канаде и без наличия работодателя. Кроме того, кандидат не должен проживать в Канаде на момент подачи заявки на иммиграцию, как это было раньше. Ранее кандидаты в данной категории должны были жить в Онтарио на момент подачи заявки на ПМЖ. Сегодня иностранные студенты получив степень Master могут проживать за пределами Канады (однако, если они проживают в Канаде, но за пределами Онтарио, они не имеют право подать заявление на ПМЖ по программе Онтарио). Выпускники со степенью PhD могут проживать за пределами Канады или в любой другой провинции Канады.

2. International Student with a Job Offer (иностранный студент с приглашением на работу)

Ontario Provincial Nomination Program (PNP)

Ontario is the province of choice for most people applying under a Federal Canadian Immigration Program. The province of Ontario also has programs for those individuals who have some connection to Ontario, for example a job offer or who have gone to school in Ontario. As is the case with all provincial nomination programs, first the province nominates an individual for Canada permanent residency and then Canadian immigration actually issues the visa.

The program is divided into three categories: a general category for foreign workers, an international student category, and an investor category.

General Category

Foreign workers may obtain Canada permanent residency under this Ontario PNP category, if there is an employer based in Ontario who offers them a job. First the employer must apply for approval, and then the prospective employee will apply with the approved position.

Both the Ontario employer and foreign worker have to fulfill the following criteria:

Ontario PNP Employer’s Criteria:

NOTE: Employers are able to request more than one position under the PNP, and the maximum number that can be requested is 20. The number of positions that an employer is able to request depends on the number of full time permanent employees at the company.

• Existed and operated as a business for at least three years before the date of application

• Declared a minimum of $1,000,000 gross revenue for last fiscal year. For companies in the Greater Toronto Area, the minimum amount is $500,000.

• A minimum of 5 full time permanent employees on the payroll. For companies in the Greater Toronto Area, there must instead be a minimum of 3 permanent full time employees.

• A location/office in Ontario

Ontario PNP Foreign Worker’s Criteria

Foreign workers cannot apply for this program until their position with their employer has already been approved. Foreign workers must have the following to qualify under this program:

• An offer of permanent full-time employment from an employer in Ontario in a skilled position approved by the province at a wage consistent with the average for the position and the location.


• A minimum of two years of work experience in the five years prior to the application date, and if necessary, the relevant registration to practice their occupation.

• An “Approved Position Form” and a a Joint Verification form, which have been submitted by the employer in a pre-screening process, and the approval letter that was granted to the employer.

• Valid immigration status in Canada if the applicant is already living in Canada (such as a valid work permit or a temporary resident visa).

Ontario PNP International Student Category

To be eligible to apply for permanent residency in Ontario as an international student with a job offer, the employer who is offering you a full time job must have first applied for the approval of your position.

Ontario PNP Job Offer Stream

This program is for individuals who have graduated from any Canadian university or college, which is publicly funded, within the last two years. Individuals can also apply during their studies so long as they have completed at least half of their studies in Canada. The duration of the program of study in Canada must be at least two years, unless it is a graduate degree program.

International students are not required to have any previous work experience.

The requirements are:

• An offer of full-time employment from an employer in Ontario in a skilled position at a wage consistent with the average for the position in the location. The position must be a managerial, professional, or skill trade occupation (classified as NOC Type 0, A or B) to be eligible.

• An “Approved Position Form” and the Joint Verification form which has been submitted by the employer in a pre-screening process

• Valid immigration status in Canada if the applicant is already living in Canada (such as your valid study permit).

Ontario PNP PhD/Masters Graduate Stream

Anyone who has graduated from a PhD or Masters program from an Ontario university receiving public funding, qualifies for this program without a job offer.

Ontario PNP Individual Investor Program

This program is designed for individuals who are investing, or setting up a company, in Ontario, which they will be actively managing. The primary function of the business cannot be a passive investment aimed at deriving interest, dividends or capital gains. The individual does not have to meet a minimum net worth requirement but must meet the following eligibility criteria:

• Create a minimum of 5 new permanent full-time positions for Canadians

• Have control over a minimum of 1/3 of the equity invested or make a minimum investment of $3,000,000 in the business venture, which cannot be redeemed at a specified time.

• The investment must be officially approved or endorsed by a Deputy Minister of an Ontario Ministry to very the amount of the investment and the job creation.

Ontario PNP Latest Rules 2020:

Ontario is Canada’s most populated province that inhabits nearly 40% of Canadians. It is a hub of economic, social and political undertakings. Ontario’s Express Entry Human Capital Priorities Stream: List of Targeted Occupations by National Occupational Classification (NOC) Codes

On June 28, 2020, the Ontario Immigrant Nominee Program (OINP) announced that it would issue targeted Notifications of Interest (NOIs) to cand > and who have work experience in the Information and Communications Technology (ICT) sector.

Opportunities Ontario: Provincial Nominee Program is expanding to allow international students graduating from Masters programs in Ontario to apply for permanent residence without a job offer.

As part of the Open Ontario Plan to create new opportunities for jobs and growth, the province is increasing the number of international students by 50 per cent while maintaining spaces for Ontario students .

Opportunities Ontario: Investors

Opportunities Ontario allows Ontario to select economic immigrants whose skills match those needed by businesses in the province . The investment component of the program helps companies making an investment in Ontario to recruit or relocate key employees to ensure the long-term success of the investment. Opportunities Ontario targeted 1,000 nominations in 2011.

Who can apply
The Ministry of Citizenship and Immigration (MCI) is the first point of contact and referral for companies or individual investors making an investment in Ontario who want to facilitate the permanent resident status of needed employees.

Investment Guidelines

To qualify, investments must be of significant importance to Ontario and must create jobs for Ontarians . New investments and expansions to current operations are eligible. Investments need to meet the following eligibility guidelines:

  • The investment must receive an official endorsement from another Ontario ministry at the Deputy Minister level for the investment and the number of key positions requested. For more information about the endorsement process, please visit the How to apply section.
  • The amount of the investment is at least $3,000,000.
  • The investment must create at least five net permanent full-time jobs for Canadian citizens or permanent residents in Ontario.
  • The investment has to also comply with Immigration and Refugee Protection Regulations (IRPR). This federal law excludes individuals from provincial nomination who:
    • are nominated because of capital provision, or
    • engage in an “immigration-linked investment scheme”.

To comply with these exclusions, individual investors seeking nomination need to meet added eligibility requirements (please see section called Eligibility Criteria for Individual Investors)


How to apply
The application process for companies making an investment as three steps:

For investment nominee applications there is a non-refundable fee of $3,500. The fee can be paid by the prospective nominee or by the investor.

Opportunities Ontario: General Category

Opportunities Ontario helps employers who are having difficulty finding the skilled workers they need. It also allows investors to bring in key employees on a permanent basis. Through the program, employers and investors can recruit foreign workers in any managerial, professional or skilled trades occupation (see the NOC 0, A or B categories).

Who can be recruited

Employers and investors may recruit qualified employees for approved positions through the General Category, whether they are abroad or in Canada with legal status (as temporary foreign workers or visitors ). All prospective nominees who are visiting or residing in Canada will be required to provide documentation of their status with their application forms. Employers will need to indicate on their application forms whether they are recruiting foreign workers from abroad or foreign workers who are in Canada with legal status.

To be eligible as a foreign worker, prospective nominees in the General Category must demonstrate that they qualify for the approved position by providing evidence that they have:

  • At least two years (24 months) of work experience (within the previous five years) in the intended occupation, or have appropriate registration in Ontario, if applying for a position in a regulated occupation in Ontario.
    • For work experience obtained abroad and in Canada, Opportunities Ontario will only accept full-time work experience that is verifiable, relevant, and paid. Unpaid or volunteer experience will not be accepted. In addition, for work experience obtained in Canada, Opportunities Ontario will only accept Canadian work experience that is obtained with proper work authorization from Citizenship and Immigration Canada (e.g., work permit) within the most recent five years.
  • A permanent full-time job offer in a skilled occupation ( NOC 0, A or B ) that Opportunities Ontario: Provincial Nominee Program has approved and that is still valid.
    • Foreign workers already working in the position that Opportunities Ontario: Provincial Nominee Program approved need to be paid a wage that is equal to or greater than the wage approved for that position. So if the wage for the position was approved at $25/hour, the temporary worker in that position will need to be paid $25/hour or more before the program nominates them.
  • Have legal status , if the prospective nominee is in Canada (e.g., a work permit, temporary resident visa). Refugee claimants and asylum seekers are not eligible for the program.
  • The employer’s approval letter , Joint Verification form signed by their prospective employer, and Pre-screen Position form.

About the process

International Student with Job Offer Stream

Opportunities Ontario helps employers who are having difficulty finding the skilled workers they need. Through the program, employers can recruit international students in any managerial, professional or skilled trades occupation (see the NOC 0, A or B) categories.

They can apply in their last semester or within two years of the date on which they receive their degree . Prospective nominees have to submit the Nominee Application Form for International Graduates (PhD and Masters).

Ontario PNP

The Ontario Immigrant Nominee Program or Ontario PNP enables skilled foreign nationals who wish to live and work in Ontario to obtain an Ontario Provincial Nomination Certificate, which allows them to apply for Canadian Permanent Residence. Home to Niagara Falls, Ontario PNP is the center of Canada’s economic, social, and political life. Ontario Immigration gives access to individuals and families to a multicultural and diverse Province of people from 200 different countries who speak more than 125 languages.

Two ways to get nominated:

  • The applicant can contact Immigration Ontario and apply for OINP directly. If given a provincial nomination, he or she can then create a Canada Express Entry profile and add their Ontario PNP nomination credentials.
  • The applicant can create an Express Entry profile and register their interest in the province within the system.
    • The Ontario PNP can then contact the person through Express Entry and formally invite them to apply to the immigration program.
    • If an applicant is then given a Ontario PNP nomination, the certificate can be transferred to them using Express Entry which will instantly increase their score under the Comprehensive Ranking System (CRS) by 600 points.

Ontario PNP Categories:

  • Foreign Worker – Employer Job Offer Stream is designed for skilled foreign workers with a job offer from an employer in Ontario.

The applicant must have:


  • Two years of work experience in their respective occupation within the past five years.
  • The appropriate registration in the province if he/she has a regulated occupation.
  • Paid and verifiable work experience.
  • A permanent, full-time job offer in a skilled occupation from an Ontario employer. According to the Canadian National Occupational Classification (NOC), skilled work experience means Managerial jobs (NOC skill type level 0), Professional jobs (NOC skill type level A) and Technical jobs/skilled trade (NOC skill type B).
  • Legal status if living in Canada during application.
  • A signed Joint Verification form and a Pre-Screen Position form by the employer.

The employer must:

  • Submit an application that needs to be approved by Opportunities Ontario and needs to be valid till the time his/her application is approved.
  • Have an active business for at least three years.
  • Have gross revenue of at least $1,000,000 with at least five permanent full-time employees for those companies in Greater Toronto Area or have gross revenue of at least $500,000 with at least three permanent full-time employees for companies outside this area.
  • Offer a job that is located inside of the province of Ontario.

The job offer must:

  • Be a permanent, full-time position.
  • Meet the wage levels for the respective position in Ontario.
  • Not affect the settlement of any labour dispute the company or its employees are involved in.
  • Not have a negative affect on the employment or training opportunities for Canadian citizens and permanent residents.
  • Offer a position that is necessary for the operation of the company.
  • International Students Category is designed for international students with a Master’s degree or a PhD obtained in Canada who want to live and work permanently in Ontario.

There are three categories within the International Students Category:

Pilot International Masters Graduate Stream applicants must:

  • Intend to live and work in Ontario.
  • Be a graduate of a Master’s program from a publicly funded University in Ontario.
  • Have completed one academic year on a full-time basis.
  • Submit the application no later than two years from the date of completion of the Masters degree. Or submit the application during his/her last semester of study in the program.
  • Be currently residing in Ontario with legal status.
  • Be proficient in English and/or French.
  • Have sufficient funds to support themselves and their dependents.
  • Have resided in Ontario for at least one full year during the past two years.

International PhD Students Stream applicants must:

  • Have graduated from an existing PhD program at an eligible publicly funded university in Ontario. Or successfully competed all of the degree requirements for such a program (and are awaiting their degree). Or, have at least two years of completed PhD studies at an eligible publicly funded university in Ontario.
  • Application must be submitted no later than two years from the date the PhD was received.
  • Be currently residing in Ontario with legal status.
  • Be proficient in English and/or French.
  • Have sufficient funds to support themselves and their dependents.

International Student with a Job Offer Stream applicants must:

  • Have completed at least half of their studies in Canada. Or, must have already graduated or be graduating from a publicly funded college or university in Canada.
  • Have completed a two-year degree or diploma program on a full-time basis from Canada or abroad. Or must have completed a one-year post-graduate degree or certificate program.
  • Have a permanent, full-time job offer in a skilled occupation (NOC Levels 0, A, or B).
    • The employer must submit an application to Opportunities Ontario. The offer must be approved and remain valid at the time the applicant’s application is approved.
    • A Joint Verification form and a Pre-Screen Position form are also required from the employer.
    • Submit the application no later than two years after the date that the student received their Canadian degree or diploma or submit it as early as the last semester of the student’s studies.
    • Have legal status of living in Canada.
    • Ontario Corporate Stream is designed to help establish and support international corporations interested in expanding into Ontario by starting or investing in a business in the province.

    Application requirements:

    • The corporation must invest $5 million or more in the new or existing Ontario PNP business.
    • Five permanent, full-time jobs must be created for Canadian citizens or Canadian permanent residents for each OINP nomination made under this category.
    • Employees must be employed by the corporation and be key to the operation of the company in Ontario.
    • Nominated staff members have 24 months to demonstrate a minimum English language requirement in accordance with nomination criteria.
    • The international business must be well established with a proven track record over the past 36 months or longer.


    • Ontario Entrepreneur Stream is designed to help foreigners buy a business in the province or create a company in the province.
    • Each prospective nominee must make a $500,000 CAD minimum investment in the Province of Ontario.
      • If the business is located in the Greater Toronto Area (GTA) the investment criteria increases to a minimum investment of $1,000,000 CAD unless the business is in the digital media or information and communications technology (ICT) sectors.
      • If the entrepreneur has a business partner who would also like to qualify under this OINP stream, he/she must also make the required minimum investment of either $500,000 CAD or $1 million CAD.
    • Each prospective nominee must have an $800,000 CAD minimum net worth.
      • If the business is located in the Greater Toronto Area this minimum net worth requirement increases to $1,500,000 unless the business is in the Digital Media or ICT industry.
    • Buying or creating a business in Ontario must create two permanent, full-time employment positions for Canadian permanent residents or citizens.
    • The entrepreneur along with his/her business partner will have 24 months to satisfy minimum program requirements in order to receive a Canada PR nomination from the Province of Ontario.
    • The entrepreneur must have a minimum of 3 years of senior management or business ownership experience in the past 5 years.
    • Human Capital Priorities Stream allows the province to select potential immigrants from the Express Entry pool that have the necessary skilled work experience, language ability, characteristics, and education to bring value to the Ontario labour market.

    The applicant must have:

        • A Bachelor’s, Master’s, or Ph.D. degree from Canada, or an Educational Credential Assessment (ECA) report indicating that their foreign education meets Canadian education requirements and standards.
        • Be proficient in English and/or French at a language level of Canadian Language Benchmark (CLB) 7
          • The applicant must provide results of a standardised language test recognized by the Government of Ontario.
        • Have a minimum of 12 months of continuous full-time employment or an equal amount of part-time work experience in a NOC level 0, A, or B occupation in the five years prior to the date of the Ontario Nomination of Interest.
        • A Canada Express Entry Comprehensive Ranking System score of 400 points or greater, and this score must remain throughout provincial and federal processing.
        • The intention to live in Ontario.
        • Have sufficient funds to support themselves and their dependents.
          • Provide proof of funds through bank statements.
        • French-Speaking Skilled Worker Stream enables prospective immigrants that speak French to move to Ontario. People that register for Express Entry, enter the Federal Skilled Worker Program or Canada Experience Class pool, and indicate an interest in Ontario immigration may be eligible for the OINP French-Speaking Skilled Worker Stream.

    The applicant must:

        • Have a Bachelor’s degree, Master’s degree, or Ph.D. degree from a Canadian institution, or the equivalent from a foreign school along with an Educational Credential Assessment (ECA) indicating that the education is equivalent to a Canadian degree.
        • Have a Canadian Language Benchmark (CLB) level of 7 or higher in French, and 6 of higher in English, which must be demonstrated by a Government of Canada and Ontario approved standardised language test.
        • Have at least 1 year of paid work experience in an NOC level 0, A, or B occupation in the past 60 months if he/she is applying through the Federal Skilled Worker Program (FSWP).
        • Have a minimum of one year of full-time employment in an NOC 0, A, or B level occupation in the past 36 months if he/she is applying to the Canadian Experience Class (CEC).
        • Intend to reside in the province and should demonstrate this intention through a statement of intent and proof of ties to Ontario.
        • Have sufficient funds to support themselves and their dependents.
          • Provide proof of funds through bank statements.
        • The Ontario entrepreneur program and the Ontario business program for corporations is designed to give companies that make an investment in Ontario the ability to recruit and retain important employees. The program allows these important employees to immigrate to Canada, ensuring the company’s investment in the process.

    Investment requirements:

        • Must receive official endorsement from another Ontario ministry at the Deputy Minister level.
        • Amount of investment must be at least $3,000,000 CAD.
        • Must create at least five permanent full-time jobs for Canadian citizens and permanent residents of Ontario.
        • Must comply with Immigration and Refugee Protection Regulations.

    The applicant must:

        • Be actively involved in the management of the business.
        • Control at least 33.3% of the business’s equity. Or make a minimum of $1 million CAD investment in the business.
        • Not have the option of redeeming investment after a certain period
        • Invest the capital in the business. However, investment can’t be for the primary purpose of deriving interest, dividends, or capital gains.
        • Be integral to the functioning of the company in question.

    Important Information:

        • Refugee claimants and asylum seekers are not eligible for the Ontario Provincial Nominee Program 2020.
        • The Pilot International Masters Graduate Stream accepts a maximum of 1000 applicants.
        • The International Student with a Job Offer Stream accepts applicants with a job offer that is not necessarily in the same field as the student’s degree or diploma.
        • Through the Ontario Corporate Stream, before being nominated by Ontario for Canada Permanent Residency (PR) status, key employees of the corporation can obtain two-year Temporary Work Permits from Citizenship and Immigration Canada (CIC) allowing them to build the business in Ontario while not yet being permanent residents.
        • The Ontario Immigrant Nominee Program considers businesses in the City of Toronto or in the Durham, Halton, Peel, or York regions as part of the Greater Toronto Area (GTA).
