Some Canadian provinces offer Canadian Permanent Residency nominations for workers in semi-skilled professions such as: manufacturing, transportation, food and beverage, and hospitality occupations.

These provincial nomination programs (PNPs) are created to support economic growth by attracting work-ready immigrants to the provinces. In general, the goal of any PNP is speed-up the process of bringing newcomers to Canada.

The National Occupational Classification (NOC) defines semi-skilled worker category ( NOC categories C and D) as a category that includes jobs that require lower levels of formal training (e.g. food and beverage servers, chambermaids – usually require a high school diploma and some on-the-job training or job-specific courses)

Alberta

A massive labour shortage is looming in Alberta and if predictions are accurate, by 2015, there will be thousands of empty positions waiting to be filled.

“It’s not an issue that’s going to be forced in the next year, the next two years, the next three years. The projections that we see is that by the year 2015, the Province of Alberta will have 100,000 vacant positions that cannot be filled,” said Ken Kobly, the president of the Alberta Chambers of Commerce.

British Columbia

Applicants must have been employed full-time in an eligible occupation by the qualified company, on a temporary work permit for at least nine consecutive months prior to the date of application to the PNP and must be legally employed by the employer at the time of application.

The tourism/hospitality, food processing and long-haul trucking industries play a key role in BC’s export-oriented economy, and are experiencing looming labour shortages. These industries have demonstrated that they won’t be able to meet their on-going workforce needs without the ability to retain foreign workers through immigration.

Below is the list of occupations that will be considered under this category:

Saskatchewan

The Saskatchewan PNP nominates nominees in the Hospitality and Long-Haul Trucking Industries

Hotel and Lodging (Hospitality)

To apply to the Hospitality Sector Project, the applicant must have completed a minimum of Grade 12 education (or its equivalent), work in Saskatchewan for a minimum of six months, have sufficient English language ability and have a valid work permit for one of the following categories:

  • Food/Beverage Server ( NOC 6453)
  • Food Counter Attendant/Kitchen Helper (NOC 6641)
  • Housekeeping/Cleaning Staff (NOC 6661)

Long Haul Truck Drivers

To be considered for the Long Haul Truck Drivers Project you must: be working on a temporary work permit for an approved Saskatchewan trucking firm for a minimum of six months, have a current Saskatchewan Class 1A driver’s license and have an offer of full-time, permanent employment from your employer, which must be an approved trucking firm in Saskatchewan.

Yukon

To qualify under the Critical Impact Worker Program the applicant must: have permanent full time position, be in trade or skill that falls into skill level C or D of the National Occupational Classification, have a temporary work permit and have worked in the position for six months or obtain a score of 45 or better on the Pre-Assessment, be able to conduct basic communications in either English or French.

Atlantic Immigration Pilot Program 2020

Canada’s Atlantic Provinces have their own immigration program that allows them to nominate the skilled and capable immigrants for the permanent residence in the province. It is a pilot immigration program that was launched in 2020 with a target of inviting 7,000 immigrants to the Atlantic region of Canada by 2020.

Note: Seeing the momentum of the AIPP, government of Canada has decided to extend the program to December 2021

Canada’s Atlantic region comprises of the provinces:

  • Nova Scotia
  • New Brunswick
  • Newfoundland and Labrador
  • Prince Edward Island

These provinces/territories with the help of the pilot immigration program – Atlantic Immigration Pilot Program (AIPP) are able to fill the gap in the local labor market of the respective provinces. Provinces invite the eligible candidates by offering them a job-offer since they are not able to find the required candidate for the job in their local market.

What are the basic steps for applying under the AIPP? Under the Atlantic Immigration Pilot Program (AIPP) there are three sub-categories that allow skilled immigrants to apply for permanent residence in these provinces and also for the international students:

  • Atlantic High-skilled Program
  • Atlantic Intermediate-Skilled Program
  • Atlantic International Graduate Program

Main theme of the AIPP is that it is an employer-driven immigration program that allows the provinces to hire a foreign worker. For candidates to apply under this program they need a job offer from an eligible employer and a settlement plan for themselves and the accompanying family members.

For a candidate to apply under this program, an eligible employer of the Atlantic province need to offer them a job-offer and makes sure that it meets the requirements of the program candidate have qualified for. Job-offered does not need to be in same field as any other previous job candidate had.

Another main requirement is a settlement plan. Once the candidate is able to get a job-offer from a designated employer, candidate and other accompanying family members’ needs to get a settlement plan. This plan will help the candidate to settle in the province. Give all the resources and links related to the candidate’s needs. All the settlement plans are free. Candidate will be working with a settlement service provider organization to help strategize the settlement plan. Once the settlement plan is created, candidate needs to provide a copy of it to their designated employer.

After getting the settlement plan, province have to endorse the job offer. This will be taken care by the employer. Candidates do not need to submit their application for permanent residency before being getting endorsed. Once the province endorses candidate job-offer, Candidate will get a Certificate of Endorsement.

What are the eligibility requirements for the AIPP 2020?

Every sub-category of the Atlantic Immigration Pilot Program has their own set of requirements and eligibility criteria.

Atlantic High-skilled Program:

To be able to apply under this program candidate needs to –

  • Worked in management, professional or technical/skilled job for at least a year.
  • Have at least a Canadian High School diploma or equivalent education.
  • Show language proficiency in either French or English language.
  • Show they will be able to support themselves and any accompanying family member when moving to Canada.

Employers also need to meet some requirements under this program.

Atlantic Intermediate-Skilled Program:

To apply under this program candidate needs to-

  • Have worked in a job that requires a high school education and/or job-specific training for at least a year.
  • Have at least a Canadian high school diploma or equivalent education.
  • Show their language proficiency in either French or English language.
  • Show they will be able to support themselves and any accompanying family member when moving to Canada.

Employers who are offering a job-offer to the candidate also need to fulfill some requirements.

Atlantic International Graduate Program:

For candidates to be able to apply under this program, they must:

  • Have a degree, diploma or other credentials from a publicly-funded institution in an Atlantic province.
  • Have lived in an Atlantic province for at least 16 months in the 2 years before getting the degree, diploma or credential
  • Need to take a language testing examination to show their language proficiency in English or French.
  • Show they will be able to support themselves financially and any accompanying family member when moving to Canada.

For the employers looking to hire the capable and skilled immigrants via this program, they first need to apply to the provinces in order to receive the designation. Every employer in the different province will require different/separate designations for each province. Employers to be able to get the nod for employing the skilled immigrants’ needs to meet certain requirements, which includes a commitment to support the newcomer and their family members to integrate into daily life in Atlantic province.

What are the documents required for Atlantic Immigration Pilot Program (AIPP)?

Candidates need to send set of documents while submitting their application. All these documents need to be prepared before getting a job offer. In this way, it can help the candidate’s application to be processed in much faster pace when they have the job offer:

LMIA form should be completed by your employer to apply for a Labour Market Impact Assessment (LMIA)

An LMIA is a document from Service Canada that “validates” a Job Offer from a Canadian Employer made to a Foreign Worker, and allows the Foreign Worker to apply for a Work Permit

This LMIA form should be completed by your employer to apply for a Labour Market Impact Assessment (LMIA) to hire temporary foreign workers under the Pilot Project for Occupations Requiring Lower Levels of Formal Training (NOC C and D).

Working temporarily in Canada: Eligibility to apply

You almost always have to apply for a work permit from outside Canada. Sometimes, you can apply from inside or as you enter Canada. Many of the requirements are the same.

Eligibility to apply from outside Canada

To apply for a work permit from outside Canada, you must submit the following documents:

  • you have a temporary resident permit that is valid for six months or more or
  • you are in Canada because you have already applied for permanent residence from inside Canada. You will have to pass certain stages in the main application process before you can be eligible for a work permit.

Eligibility to apply as you enter Canada

You can apply for a work permit as you enter Canada, but only if you meet the following requirements:

  • you are temporary resident visa exempt and
  • your job does not need a labour market opinion from HRSDC (some exceptions apply) or
  • you hold a labour market opinion from HRSDC .

Note: if your job does need a labour market opinion, you can apply as you enter Canada as long as the positive opinion has been issued to you before you enter (except for live-in caregivers and seasonal agricultural workers).

People in the following categories need a work permit but do not need a labour market opinion from Human Resources and Skills Development Canada (HRSDC ).

  • Workers covered under international agreements
    Professionals, traders, investors and business people coming to Canada to work under certain international agreements
  • Entrepreneurs and intra-company transferees
    Some types of entrepreneurs, workers transferring within a company, and other types of workers who will provide significant benefit to Canadians or permanent residents by working in Canada
  • Participants in exchange programs
    People whose employment in Canada will provide similar employment to Canadians abroad, such as participants in youth exchange programs, teacher exchange programs or other reciprocal programs
  • Co-op students
    Foreign students who are studying in Canada and who need to do co-op work placements as part of their program of study
  • Spouses
    Spouses and common-law partners of certain foreign workers and of certain foreign students who are currently studying or working under the Post-Graduation Work Permit Program
    • Spouses of certain foreign students may obtain a work permit without having to obtain a labour market opinion from HRSDC . This exemption applies to spouses who are not themselves enrolled in full-time studies.
    • Eligibility criteria: To be allowed to work in this category, you must prove that you are the spouse of a student who holds a valid student permit and who is studying full time at a post-secondary institution—a university, a community college, a CEGEP , a technical or school of commercial studies—that is financed by the private or public sector and authorized by provincial law to award university degrees.
    • Academics and students
      Certain academics and students
    • Religious workers
      People doing charitable or religious work
    • Others
      Certain people who need to support themselves while they are in Canada for other reasons such as the refugee determination process

North American Free Trade Agreement (NAFTA )

A professional must:

An intra-company transferee must:

  • have worked continuously for at least one year in the preceding three years for the same or affiliated employer in the United States or Mexico
  • be transferred to Canada to work temporarily for the same or an affiliated employer and
  • work in a capacity that is managerial, executive or that involves specialized knowledge.

A trader or an investor must:

  • be seeking to carry out substantial trade in goods or services, mainly between Canada and her or his country of citizenship, or conduct substantial investment activities in Canada, in a supervisory or an executive capacity, or in a capacity that involves essential skills
  • meet additional requirements under NAFTA and
  • have a work permit.

Can my spouse or common-law partner work in Canada?

If your spouse or common-law partner wants to work while in Canada, they must apply for their own work permit. Normally, they must meet the same requirements that you do, including obtaining (if needed) a labour market opinion (LMO ) from Human Resources and Skills Development Canada.

However, your spouse or common-law partner may be eligible to apply for an “open” work permit that will allow her or him to accept any job with any employer if you meet the conditions outlined below:

A. You are authorized to work in Canada for six months or longer and the work you are doing while you live in Canada meets a minimum skill level (usually work that would require at least a college diploma). Specifically, your job must be listed in Skill Level 0, A or B in the National Occupational Classification ;

B. You are authorized to work in Canada and the work you are doing while you live in Canada is included in a list of eligible occupations in participating provinces.

In each of the above cases, your spouse’s permit will be valid for the same period as yours.

If you are authorized to work in Canada and the work you are doing while you live in Canada is included in the list of eligible occupations below, your spouse or common-law partner may apply for an “open” work permit that will allow her or him to accept any job with any employer.

The following list describes the eligible occupations in their participating provinces.

  • Long Haul Truck Driver

This is a pilot project that will operate from August 17th, 2009 to July 30th, 2012. The qualifying work permits must be received within these dates.

Note: You must possess a letter of offer confirming your employment as a Long Haul Truck Driver.

  • Learn about occupations that are exempt from the HRSDC/Service Canada Labour Market Opinion .
  • Learn about occupations that are exempt from the CIC work permit .

Special criteria apply if you hire foreign workers in some industry sectors and occupations including:

Under the facilitated process, employers wanting to hire foreign workers in any of the following occupations are deemed to have an implied Labour Market Opinion (LMO) (which is not subject to the six-month time validity that applies to other LMOs):

  • Senior animation effects editors
  • Embedded systems software designers
  • MIS software designers
  • Multimedia software developers
  • Software developers — services
  • Software products developers
  • Telecommunications software designers

Please be advised that on September 30, 2010, the facilitated process for IT specialists will come to an end . This process applies for all positions in Canada, except in Quebec and British Columbia, where the facilitated process will remain in place for a limited time after September 30, 2010. Employers interested in hiring temporary foreign workers in one of the seven IT occupations, covered by the former facilitated process in British Columbia, will be required to advise Service Canada and the Ministry of Advanced Education and Labour Market Development. Exemptions from the HRSDC process

In the case of IT specialists, you should be aware that under the North American Free Trade Agreement, Canadian employers may hire American and Mexican citizens in the following occupations without needing an LMO:

  • Computer Systems Analysts with a Bachelor’s degree, or a post-secondary degree, or a post-secondary diploma and three years work experience ;
  • Engineers with a Bachelor’s degree or state/provincial license ;
  • Graphic Designers with a Bachelor’s degree, or a post-secondary diploma, or a post-secondary certificate and three years work.

Foreign workers that meet the conditions above may apply for a CIC work permit directly at a CIC Mission abroad, or at a port of entry.

Q: I have a work permit under an International Youth Exchange Program. Can I apply for a work permit extension under the Pilot Project?

A: Yes, if your employer has an approved LMO for the job offer. You can work for another 24 months under the Low Skill Pilot before you must leave Canada.

Temporary foreign workers returning to Canada

If you are a temporary foreign worker presently in Canada, and wish to leave for a short time (for example, to visit your home country) and then return to Canada, you should be aware of the following:

Temporary foreign workers who require both a temporary resident visa and a work permit

If you require a visa to enter Canada and a work permit to legally work, you may only re-enter Canada to work as long as both your visa and work permit are still valid when you return. Your passport must also be valid.

If your visa has expired but the work permit is still valid, you must apply for another temporary resident visa to return to Canada. If your work permit has expired, but your visa is still valid, you will need to apply for a new work permit. In both cases, you must apply for either a visa or a work permit at a visa office outside Canada before returning to Canada.

Your temporary resident visa, work permit and passport all need to be valid if you want to return to Canada to work. Otherwise you may be refused entry to Canada.

Temporary foreign workers who require only a work permit

If you do not require a temporary resident visa because you are a national of a visa-exempt country and you wish to return to Canada to work, you must have a valid work permit and passport when you return.

If your work permit has expired you will need to apply for a new work permit at a visa office outside of Canada before returning to Canada. You will also require a valid passport. Otherwise you may be refused entry to Canada.

How can I extend my stay as worker?

If you want to extend your stay in Canada, you should apply at least 30 days before your status expires.

Depending on your situation, you may need to use a different application form. For example, if you have a new job offer in Canada, you will need to apply for a new work permit. See Extending your stay as a worker for details.

Your employer may also need to apply for a new Labour Market Opinion (a document from Human Resources and Skills Development Canada which says your employer is allowed to hire you). See Extending a worker.

Temporary residents currently in Canada with valid student or temporary foreign worker status must submit their application for a new temporary resident visa to the Case Processing Pilot Office in Ottawa (CPP-O ), or visa office that serves their country of nationality.

    If your work permit expires after you have submitted your application for an extension but before you receive a decision on your application, you can stay in Canada under what’s called implied status. That means the law implies you are a temporary resident. That status lasts until Citizenship and Immigration Canada (CIC ) dec >If you applied for another work permit:

    You must stay in Canada and meet the conditions of your original work permit. If you applied for a work permit extension before your work permit expired, you can keep working under the same conditions as your existing permit until CIC dec >If you applied for a different kind of permit:

  • You cannot do any of the activities allowed by the original work permit. For example, you may have come to Canada as a worker and then applied for a study permit. If so, you must stop working once your work permit expires. After that, you cannot work or study until you get a new permit.
  • If you have applied to extend your work permit and plan on traveling outside Canada while your application is in process, you can leave Canada and come back. However, one of three things will happen when you return to Canada:
    • You may be allowed to come back to Canada as a visitor, if Citizenship and Immigration Canada (CIC ) has not yet decided to extend your work permit. If this is the case, you cannot work until you get your work permit extension. The officer at the port of entry may ask you to prove you have enough money to support yourself in Canada.
    • You may be allowed to come back to Canada as a worker, if the officer at the port of entry finds out that CIC extended your work permit while you were away.
    • You may be asked to apply for a new work permit at the port of entry.

    Note: It is possible that you will not be able to enter Canada. The final decision is made at the border by the border services officer.

    The Saskatchewan Occupations In-Demand sub-category of the Saskatchewan Immigrant Nominee Program (SINP) International Skilled Worker category targets skilled workers in key occupations. If you have recent work experience in a high-skilled occupations that is not on the SINP Excluded Occupations List below, Saskatchewan’s Occupations In-Demand sub-category could be your route to Canadian immigration.

    Important change: In September, 2020, Saskatchewan changed the eligibility requirements for the Occupations In-Demand sub-category. Previously, candidates had to have work experience in an occupation listed on Saskatchewan’s in-demand list. Now, candidates must have work experience in a high-skilled occupation that is not listed on Saskatchewan’s Excluded Occupations List.

    • Saskatchewan considers high-skilled work experience to be any work experience obtained at National Occupational Classification (NOC) Skill Level 0, A, or B.

    The Saskatchewan Occupations In-Demand sub-category is not aligned with the federal Express Entry system. Consequently, successful applicants can apply directly to the Canadian government for permanent resident status, and do not need to create an Express Entry profile, or receive an invitation to apply (ITA) in an Express Entry draw, in order to apply.

    Potential candidates may be outside Canada, or in Canada with legal status, and a job offer is not required.

    Since July, 2020, the Saskatchewan Occupations In-Demand sub-category operates within Saskatchewan’s new Expression of Interest (EOI) system.

    To help determine the success of the Pilot, ongoing reporting by employers, settlement service provider organizations and provinces to Immigration, Refugees and Citizenship Canada will be in place. Details on reporting requirements will be available later in 2020.

    Employer designation process

    The Atlantic provinces are now accepting applications from employers that would like to hire skilled immigrants under the Pilot. Employers with locations in multiple Atlantic provinces will require separate a designation for each province.

    To become designated, employers must meet certain requirements, including a commitment to support the newcomer and their family as they integrate into their new life in Atlantic Canada.

    The work experience, education, and job offer you need will depend on whether you are applying as a worker or an international student graduate. The other requirements are the same for both.

    Work experience

    You must have worked at least one year (1,560 hours total or 30 hours per week) within the last three years. It can be full-time, non-continuous, or part-time, as long as it adds up to 1,560 hours.

    The work must be:

    • in one occupation (but can be with different employers)
    • paid (volunteering or unpaid internships do not count)
    • at skill type/level 0, A, B, or C of the National Occupational Classification (NOC)

    Check the requirements to make sure you select the right job.

    The experience can be gained from inside or outside Canada.

    International graduates

    • You do not need any work experience.

    Workers apply as either high-skilled workers or intermediate-skilled workers. High-skilled workers need their one year of work experience to be at skill type/level 0, A, or B. Intermediate-skilled workers need their one year of work experience to be at the skill level C. If you are eligible to apply for both, apply as a high-skilled worker.

    Education
    • a Canadian secondary (high school) or post-secondary certificate, diploma or degree,
    • a foreign degree, diploma, certificate, or trade or apprenticeship education credential. You need an Educational Credential Assessment (ECA) report to make sure it is valid and equal to a Canadian credential.The report must show your education is equal to a completed Canadian secondary (high school) or post-secondary certificate, diploma or degree. Your ECA must be less than five years old when you apply.

    International graduates

    • a minimum 2 year degree, diploma, certificate, or trade or apprenticeship credential from a recognized publicly-funded institution in an Atlantic province
    • been a full-time student in Canada for at least two years
    • graduated in the last 12 months when you apply
    • lived in one of the Atlantic provinces for at least 16 months in the last 2 years before you graduated
    • had the visa or permit needed to work, study or train in Canada

    Your study or training program cannot be:

    • English or French second language courses for more than half of the program, or
    • distance learning undertaken for more than half the length of the program.

    You can’t apply if you had a scholarship or fellowship requiring you to return to your home country after you graduate.

    Job offer
    • from a designated employer in an Atlantic province (New Brunswick, Newfoundland and Labrador, Nova Scotia, or Prince Edward Island)
    • non-seasonal
    • reviewed by the province (details on the endorsement process will be available in early March 2020)

    The National Occupational Classification (NOC) and duration of the job offer depends on your application.

    Job offers for high-skilled workers must:

    • be skill type/level 0, A, or B
    • last at least one year

    Job offers for intermediate-skilled workers must:

    • be skill type/level 0, A, B, or C
    • be indeterminate (permanent)

    Job offers for international graduates must:

    • be skill type/level 0, A, B, or C
    • last at least one year

    Your job offer does not need to be in the same occupation as your past work experience. However, you need to meet employment requirements for the job you are offered. The requirements are listed in the NOC.

    The employer does not need a Labour Market Impact Assessment. Contact the provinces to learn which employers are hiring with this program:

    New Brunswick
    Newfoundland and Labrador
    Nova Scotia
    Prince Edward Island

    Language
    • have at least a level four (4) in the Canadian Language Benchmarks in English or the Niveaux de compétence linguistique canadiens in French, and
    • take an approved language test that shows you meet the level for speaking, listening, reading and writing.

    Your results must be less than two years old when you apply.

    Proof of funds

    You do not need to show proof if you are already living and working in Canada with a valid work permit.
