Police Clearance Certificates for Express Entry Invitation to Apply Application

Anyone applying for permanent residence in Canada through Express Entry who has received an invitation to apply (ITA), must show police clearance certificates in order to submit a complete application.

REMINDER: HOW EXPRESS ENTRY WORKS

Candidates who are eligible for one of the programs under Express Entry can submit a profile to the Express Entry pool. Their profile is assigned a CRS score, and the highest-ranking candidates are periodically issued invitations to apply for permanent residence. Once candidates who receive an ITA submit an application for permanent residence through Express Entry, their application is usually processed within six months.

Once you receive an ITA, you only have 90 days to gather all the required documents to complete your application for permanent residence. One of the documents that you’ll need is the police clearance certificate.

Applicants are required to show a police clearance certificate for themselves, as well as any immediate family members who are above the age of 18, whether they are accompanying you or not. You, and each applicable family member, need to show a police clearance certificate for each country or region where you have spent time for at least six months since the age of 18.

What is a Police Clearance Certificate?

A police clearance certificate is a document that attests to any criminal activity. For Canadian immigration purposes, it is proof that you have not been involved in any criminal activity and that you do not have a criminal record that could impact your admissibility to the country.

A police clearance certificate will be different in each territory or country and may be known by various names including:

  • Police clearance certificates
  • Judicial record extracts
  • Good conduct certificate

When Should I Get a Police Clearance Certificate?

Police clearance certificates are valid for one year from the date they were issued. However, police clearance certificates from the country in which you currently reside have to have been issued within six months from when you submit your application for permanent residence.

Police clearance certificates from countries that you no longer reside in have to have been issued after you left the country for the last time.

Since police clearance certificates have a pretty short validity period, we usually recommend to our clients that they wait until they receive an ITA before applying for all applicable police clearance certificates.

If it takes longer than 90 days to process your application for a police clearance certificate, don’t worry. You can apply for an extension from Immigration, Refugees and Citizenship Canada (IRCC) as long as you can demonstrate that you have applied for the missing police clearance certificate.

Which Countries Should I Show a Certificate For?

You need to show a police clearance certificate for any country that you have lived in for six or more months.

IMMIGRATION TIP

If the total amount of time you have spent in any country since turning 18 is six months or more, you will need a police clearance certificate from that country, even if your time in that country happened in small instalments over a long period of time, and even if you never had a fixed address in that country.

For example, if you visited, worked or lived in any country for two months, and then left the country for a few years, then returned for four months, this will still count as having spent six months there. You would therefore require a police clearance certificate from that country.

It is important to note that if the police clearance certificate is in a language other than English or French, then you must include a translation done by a certified translator.

How to Get a Police Clearance Certificate?

The process for obtaining a police clearance certificate may vary depending on the country or region. Usually, the most common way to get one is to get in touch with local police or government and request the certificate.

Applicants are usually required to provide information including photographs, fingerprints, addresses, dates you lived in a particular country or territory, and a processing fee.

If you have lived in a country or territory that has now changed its name or status, then the police clearance certificate must come from the present day national authorities of the country.

Hi
We are applying for PCC from Consulate General of India, Atlanta.

For the purpose we need to send notarised copy of our VISA page on passport and I-94.

Our Visa stamp affixed on the passport have expired, but we do have a valid I-797. Should we send that instead of the VISA page?

Also could someone give us the information of how and where can we notarise these I-94 and I-797 documents?
Thank you!

If you apply in person, they will return the passport to you then and there after verification.

There is no need to be scared. You can send the passport by mail to Houston Indian embassy. That’s normal.

Divya June 13, 2020

My passport was issued by SF consulate this April and I applied for PCC yesterday at the same consulate.

There is no same day turnaround for this request considering that passport is issued from the same consulate. Please remove this part from the article.

I still have to wait a month to receive PCC. Hopefully there are no delays on their part. I need this for Canada immigration and have a deadline of 30 days, I have asked for extension but haven’t heard back yet.

There is no expedited process for this request. Does any body has experience where it took more than a month to receive PCC? please share.
Thanks!

It depends on who issued the passport and which Indian embassy you are applying to.

My update- I got my PCC from SF consulate after 30 days. In my case, they sticked to 1 month turnaround time.

Police Clearance Certificate (PCC) из США Канада

A police clearance certificate (PCC) is a proof of your good conduct. It is available for applicants who are currently residing in the UAE and also for those who are no longer residing in the UAE. Learn how to apply and what are the documents needed.

Apply for a Police Clearance Certificate (PCC)

  • Apply for clear criminal record certificate – Ministry of Interior
  • Apply for good conduct certificate from Abu Dhabi Police – Abu Dhabi Government portal
  • Apply for police clearance certificate in Dubai- Dubai Police

What is a PCC?

A Police Clearance Certificate (PCC), known also as ‘Good Conduct Certificate’ is a proof of the person’s criminal record or the lack of it in the state in which he/she resides. In the UAE, the certificate is issued by police departments across the UAE and it indicates that the person is not accused or does not have any criminal precedents.

How to apply?

The PCC is available for applicants who are currently residing in the UAE, or those who are no longer UAE residents.

You can apply for the certificate online through the Ministry of Interior’s website and/or their smartphone app MOI UAE available on iTunes and Google Play. You can also visit one of the MOI’s services centres and get the document done after filling the application form and paying applicable fees through the electronic payment cards.

In Dubai, the service is available through the Dubai Police’s website or through the Dubai Police smart app available on iTunes and Google Play. You can get it offline through the Dubai Police’s offices.

The following documents are required:

  • a valid emirates ID card
  • a letter from the beneficiary stating that he/she does not have any pending criminal convictions
  • a recent passport-size photograph
  • a copy of the applicant’s passport.

If you are no longer a resident of the UAE, you need to get your fingerprint card from the country you are residing in and have it attested by the UAE Embassy there. A f ingerprint card is an official report from the police department concerned, which verifies the identity of a person based on his biometrics and decimal fingerprint. Then, you can send your request for PCC online to Ministry of interior- UAE or to Dubai Police along with the following documents:

  • fingerprint card approved by the UAE Embassy
  • two recent passport-sized photographs
  • a copy of your valid passport
  • a copy of your last UAE visa
  • the reason for the application.

The certificate is issued upon the beneficiary’s request to be submitted to official bodies for many purposes, which include work, study, immigration, obtaining licences and others.

The certificate can be issued in both Arabic and English. Fees differ according to the language, the applicant’s nationality and the applicant’s current place of residence.

Fees and time of the service are indicated in the service card.

Police Clearance Certificate (PCC) из США Канада

Police certificates are required for each visa applicant aged 16 years or older. Present and former residents of the United States should NOT obtain any police certificates covering their residence in the U.S.

Please note that these police certificates are required only if you are getting an immigrant visa or other nonimmigrant visa such as K, V. They are NOT required if you are doing an Adjustment of Status (I-485) within the U.S.

Police certificates must cover the entire period of the applicant’s residence in a given area. The term «police certificate» means a certification by appropriate police authorities stating what their records show concerning each applicant, including all arrests, the reasons for the arrests, and the disposition of each case of which there is a record. Police certificates from certain countries are considered unobtainable.

In some cases, there may be specific Police Certificate Request forms that must be submitted in order to properly request and obtain the applicable Police Certificate(s) based on the applicant’s residence history.

The table below shows how many police certificates are required based on where each applicant lives and has lived previously.

IF the applicant is living in their country of nationality at their current residence for more than 6 months
AND is 16 years old or older
THEN the applicant needs a police certificate from the police authorities of that locality.

IF the applicant lived in a different part of their country of nationality for more than 6 months
AND was 16 years or older at that time
THEN the applicant needs a police certificate from the police authorities of that locality.

IF the applicant lived in a different country for more than 12 months
AND was 16 years or older at that time
THEN the applicant needs a police certificate from the police authorities of that locality.

IF the applicant was arrested for any reason, regardless of how long they lived there
AND was any age at that time
THEN the applicant needs a police certificate from the police authorities of that locality.

Please look at the Reciprocity by Country to see the country specific police certificate availabilitiy.

Please refer to the chart below to find out where to get the police clearance certificate(s) from:

1. The passport office that issued your passport.

2. The district police office serving the applicant’s place of residence

1. The passport office that issued your passport.

2. If obtainable, for all countries other than India where you have lived for over one year after turning 16.

2. The district police office serving the applicant’s place of residence

3. If obtainable, for all countries other than India where you have lived for over one year after turning 16.

1. The passport office that issued your passport.

2. If obtainable, for all countries other than India where you have lived for over one year after turning 16.

Police certificates need to be obtained for only during the time period when the applicant was 16 years or older. However, if the person was arrested for any reason, regardless of how long they lived there, and was any age at that time, the police clearance certificate from the police authorites of that locality is required.

Police certificates from the local passport office are considered usually more dependable than those obtained at a local level and indicate that the person had no serious criminal convictions on the record at the time of passport issuance. Each applicant will need to bring the interview letter provided by the National Visa Center in order to request the Passport Office Police Certificate from the Passport Office.

If your passport was issued after 1997, the regional passport office will issue Police Clearance Certificate (PCC) in 1 day as they did computerization after that and have the data. If the passport was issued before 1997, it will take anywhere from 10 to 30 days.

To apply at Regional Passport Office , please use this form.

If you are currently not staying in India, but in the United States, you do not need to get the police certificate from local police station nor regional passport office in India. In that case, you can get a police clearance from your local Indian consulate (Indian consulates worldwide). They do it on the basis of a passport check.

This is a document issued by the embassy/consulate certifying that you have never been involved with the Indian police. The normal procedure for issuing a PCC is that the embassy/consulate checks with the police authorities in the area(s) in India where you had been residing, and issues the PCC after obtaining their clearance. As this procedure generally takes some time, an alternative is for you to directly approach the relevant police authorities in India (or request your friends/relatives to do so on your behalf) and obtain a certificate from them that you have not been involved in any police case during the period of your stay in India (please ensure that the relevant dates (stayed in India from so-and-so date to so-and-so date) are included in the certificate).

The Embassy of India, does not accept consular service applications through U.S. Postal Mail. It is suggested that applicants may apply for the services either at the Embassy Counter or send the application through a courier. This arrangement will continue until the situation improves.

The following return mail charges should be sent for return of serviced passports in addition to the prescribed visa fee. The Embassy/Consulate is not responsible for documents lost in the mail. Express Mail: $20, Registered Mail: $10, Priority Mail: $7, Certified Mail: $5 For each additional passport a charge of $ 1/- would be levied as mailing charges. Applicants can also send a self addressed prepaid return envelope with the application in lieu of mailing charges.

To apply for a police clearance certificate, you should fill the Miscellaneous Service Form (taken from Indian Embassy in Washington DC, but will work in another consulates too). You also need to take/send your passport and passport size photograph (affixed in the form) for this. It is advisable to apply in person. When you apply in person, also carry a photocopy of the passport and submit that photocopy to the consulate. Also take a copy of your H1/H4 visa approval notice. The fee for police Clearance Certificate is $11. The fee should be paid by Money Order/ Cashier checks made in favor of the Embassy of India/Consulate General of India. Cash is accepted only at the counter. Personal checks are not accepted. Additionally, you should pay $22 for telex charges if you would like to get the PCC on expedited basis.
PCC includes a stamp in the passport and PCC document saying that ‘that they do not have any adverse findings against you that might affect your U.S. visa’.

Information about police certificates from Canada can be found here.

They are also called RCMP certificates as police certificates from Canada are obtained from RCMP (Royal Canadian Mounted Police). Police certificates are required for consular processing for those currently living in Canada for 6 months or longer or for those not currently living in Canada, but who did live in Canada for more than 1 year.

If you look up the blue pages (government offices) of your phone book, you will see RCMP phone # under «Canada» section. In Toronto the number is 416-363-9072

There are two types of police certificates, one is name check based and other is fingerprint based. Only name check based police certificates are required for U.S. immigration. Fingerprint based police certificates are for Canadian immigration.

Other than a valid reason they do not generally do it, just like that. So you have to tell them you need to do it for «U.S. Immigration».

The police station issuing the clearance will red stamp an approval and on the bottom of the form you will see a note; «details cannot be confirmed as relating to the subject of inquiry without fingerprint comparison». Do not be alarmed by this because fingerprints are NOT required. If, during your consulate interview the consular officer finds your police clearance has a «hit» or name check problem you may be instructed to be fingerprinted. In this case the U.S. consular post will furnish Form FD-258 to be used for fingerprinting. This is the only form they will authorize for fingerprinting. Not any RCMP fingerprint form. Anyone who has initiated on their own to secure RCMP fingerprints is wasting their time. The consular officer has to witness the issuance of finger printing for authenticity. The RCMP fingerprint form is used for Canadian immigration or criminal processing.

United Kingdom
It takes less than 4 weeks to get the police certificate from UK.

Germany
Please note that PCC information is not available from the above site. One has to call the German Embassy/Consulate and request for the appropriate forms and instructions, which will then be sent by mail to the requestor’s address. The concept of checks doesn’t exist or at least not used extensively in Germany. So payment has to be made by a direct bank transfer (details given in the instructions) or via an international money order in Euros.

You need 1 for the USA if a non-Resident (never had US PR or Citizenship)
1. From the FBI

This is slow (3-4 months).

You need 2 for the USA if Resident (had US PR or Citizenship and continue residency there).

1. From local State/City PD
2. From the FBI

1. is fast (within 2-3 weeks)
2. is slow (can take 3-4 months)

So here is what you do:

1. Get the fingerprint cards (1 or 2 sets) from the FBI website.
http://www.fbi.gov/about-us/cjis/bac. nt-form-fd-258
2. Go to the local AU police station with the card(s) and the stamped (postage attached) envelope(s) as the AU police station will mail out the card(s) in the envelope(s) to the US police Dept. and FBI
3. Get fingerprint set(s) done at the AU police station ($40/set when I did it in 2006). Local closest one is fine, even on a Saturday
4. Have AU Police send the envelopes

The addresses for the FBI and the PD for each state are on form 47P:
http://www.immi.gov.au/allforms/char. cter-penal.pdf

I know there is a fee for the FBI check, but can’t find the current information, please hunt around the website or call the FBI.

I have a few queries in this regard.
1) Could you let me know the procedure for obtaining USA police clearance living in Australia?
2) What are the costs associated with it?
3) How much time would it take to get the PCC?

Any help would be appreciated.
Thank you!
